Civil Partnership Dissolution and Same-Sex Divorce

How do you get divorced as a same-sex couple? Same-sex divorce

In 2014, couples of the same sex gained the right to marry and therefore, to divorce, following the same procedures as heterosexual couples. Legally, no distinction exists between same-sex and opposite-sex marriages, enabling same-sex divorce by asserting an irreparable marriage breakdown.

Since April 6, 2022, no specific reason is needed for divorce, just recognising an irretrievable breakdown. This change introduced the ‘no-fault’ divorce, aiming for a smoother process. A joint divorce application is now required, necessitating agreement at three stages. Consider exploring Resolution Together, a service for managing separation consequences with a shared lawyer.

How do you dissolve a civil partnership?

Furthermore, since 2005, same-sex couples have been able to form a civil partnership, affording them equivalent legal protection as married couples. They can opt to convert their partnership into a marriage.

While civil partners opt for partnership dissolution over divorce, the processes and fundamental principles remain largely the same.
